Acceptance of Terms
By downloading, installing, or using the Comme mobile application (“App”), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
The Service
Comme is a curated restaurant and place discovery platform. The App allows members to discover handpicked restaurants, save their favorites, mark places they have visited, create lists, and connect with other members.
Your Account
- Be at least 16 years of age
- Provide accurate and complete information during registration
- Maintain only one account per person
- Keep your account credentials secure
User Conduct
When using Comme, you agree not to post spam or misleading content, harass other members, impersonate any person, use the App for unlawful purposes, scrape or crawl the App, attempt to reverse-engineer the App, or upload malicious code.
User Content
You retain ownership of your User Content. By submitting content, you grant Comme a non-exclusive, worldwide, royalty-free license to use, display, and distribute it in connection with operating the App. We reserve the right to remove content that violates these Terms.
Intellectual Property
The Comme name, logo, branding, visual design, and all associated intellectual property are owned by Comme and protected by applicable laws. Restaurant information is provided for personal use only.
EU Consumer Rights
If you are a consumer in the EU/EEA, you benefit from mandatory consumer protection laws in your country of residence. Nothing in these Terms affects your rights under such laws. You have a 14-day right of withdrawal under EU consumer law.
Disclaimers
The App is provided “as is” and “as available” without warranties of any kind. We do not guarantee the accuracy of restaurant information or that the App will be available at all times.
Limitation of Liability
To the maximum extent permitted by law, Comme shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed fifty US dollars (USD $50) or the amount you have paid us in the twelve months preceding the claim.
Termination
We may suspend or terminate your account at any time for conduct that violates these Terms. You may delete your account at any time through the App's settings or by contacting us.
Governing Law
These Terms shall be governed by the laws of Peru. EU consumers may also benefit from mandatory provisions of local law and may bring disputes before courts in their country of residence.
