Zero-Tolerance Policy for Objectionable Content
Comme has zero tolerance for objectionable content or abusive users. By using Comme, you agree not to post or share content that is hateful, sexually explicit, harassing, threatening, defamatory, violent, illegal, or that promotes discrimination of any kind.
Users who post such content, harass other users, or engage in abusive behavior will have their content removed and their accounts terminated, without prior notice and at our sole discretion.
Reporting and blocking: Every piece of user-generated content in the app includes a Report option. Every user profile includes a Block option that hides their content from your feed instantly. We review all reports within 24 hours and act on violations by removing content and ejecting offending users.
To report content or a user outside the app, email reports@joincomme.com.
Acceptance of Terms
By downloading, installing, or using the Comme mobile application ("App"), you agree to be bound by these Terms of Service ("Terms") and the Zero-Tolerance Policy above. If you do not agree to these Terms, do not use the App. We may update these Terms from time to time, and your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
The Service
Comme is a curated restaurant and place discovery platform. The App allows members to discover handpicked restaurants, save their favorites, mark places they have visited, create lists, and connect with other members.
Your Account
To use Comme, you must:
- Be at least 16 years of age
- Provide accurate and complete information during registration
- Maintain only one account per person
- Keep your account credentials secure and not share them with others
You are responsible for all activity that occurs under your account. If you believe your account has been compromised, please contact us immediately at hello@joincomme.com.
User Conduct
When using Comme, you agree not to:
- Post spam, misleading content, or fake reviews
- Harass, threaten, or abuse other members
- Impersonate any person or entity
- Use the App for any unlawful purpose
- Scrape, crawl, or use automated means to access the App or its data
- Attempt to reverse-engineer, decompile, or otherwise extract the source code of the App
- Interfere with or disrupt the integrity or performance of the App
- Upload malicious code, viruses, or harmful content
User Content
You may submit content through the App, including profile information, photos, and other materials ("User Content"). By submitting User Content, you:
- Retain ownership of your User Content
- Grant Comme a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the App
- Represent that you have the right to submit the content and that it does not violate any third party's rights
We reserve the right to remove or moderate any User Content that violates these Terms or that we deem inappropriate, at our sole discretion and without prior notice.
Intellectual Property
The Comme name, logo, branding, visual design, App content, and all associated intellectual property are owned by Comme and are protected by applicable intellectual property laws. You may not use, reproduce, modify, or distribute any of our intellectual property without our prior written consent.
Restaurant information, descriptions, and curated content within the App are provided for personal use only and may not be copied, scraped, or republished without authorization.
EU Consumer Rights
If you are a consumer residing in the European Union (EU) or European Economic Area (EEA), you benefit from mandatory consumer protection laws in your country of residence. Nothing in these Terms shall affect your rights under such laws.
Right of withdrawal: Under EU consumer law, you have a 14-day right of withdrawal from the date of entering into a contract for digital services. However, by using the App immediately upon creating your account, you acknowledge that the service begins right away. For free services, no refund applies. If we introduce paid features in the future, withdrawal rights for those features will be communicated at the time of purchase.
Conformity of digital services: We are responsible for ensuring that the App conforms to these Terms and functions as described. If the App does not conform, you may be entitled to remedies under the EU Digital Content Directive (Directive 2019/770).
Disclaimers
The App and all content within it are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Specifically:
- We do not guarantee the accuracy, completeness, or timeliness of restaurant information, including hours, menus, or availability
- We do not endorse or assume responsibility for any restaurant listed on the App
- We do not guarantee that the App will be available at all times or free from errors or interruptions
- Your use of the App and any decisions based on restaurant information are at your own risk
For EU consumers: these disclaimers apply only to the extent permitted by applicable EU consumer protection laws. Your statutory rights are not affected.
Limitation of Liability
To the maximum extent permitted by applicable law, Comme and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the App.
In no event shall our total liability to you exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty US dollars (USD $50), whichever is greater.
For EU consumers: this limitation of liability does not apply to damages caused by our intentional misconduct or gross negligence, or in any other case where liability cannot be limited under applicable EU law.
Termination
We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for conduct that we believe:
- Violates these Terms
- Is harmful to other members, the community, or the App
- Involves abuse of the App's features or community
You may also delete your account at any time through the App's settings or by contacting us. Upon termination, your right to use the App will cease immediately. We will delete your personal data in accordance with our Privacy Policy.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Peru, without regard to its conflict of law provisions.
For EU consumers: If you are a consumer residing in the EU/EEA, you will also benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law. Any disputes may be brought before the competent courts of your country of residence.
Dispute Resolution
We are committed to resolving disputes amicably. If you have a complaint or dispute, please contact us first at hello@joincomme.com so we can try to resolve it directly.
EU Online Dispute Resolution: If you are a consumer in the EU and we are unable to resolve your complaint, you may use the European Commission's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.
Changes to These Terms
We may revise these Terms at any time by posting the updated version on the App or our website. The "Last updated" date at the top will reflect the most recent revision. Material changes will be communicated through the App or by email. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
